TERMS AND CONDITIONS 

By joining fsboamerica.org, you agree to the terms and conditions set forth in the sign-up process and herein.  Fsboamerica.org is copy written, owned, licensed and controlled by FSBO AMERICA LLC.  You agree to advertise your property for sale on fsboamerica.org free for the first 30 days and at a cost of twenty-five dollars ($25) per month for each month or fraction thereof that your property is advertised on fsboamerica.org following the free period.  You authorize fsboamerica.org to charge the credit card that you have placed on file during the sign-up process on the 31^st day your property is actively advertised on the site and on each monthly anniversary date so long as your property is actively advertised on the site.  Fsboamerica.org has the right to charge a different credit card in the event that you change the credit card number on file prior to the next billing date.

You also authorize fsboamerica.org to send you emails with updates and information.  Fsboamerica.org will also email you suggests for improving your listing (s) upon request.

Eligibility

Our services are only available to individuals or businesses that can form legally binding contracts under applicable law.  Without limiting the foregoing, our service is not available to minors, persons who are suspended from use of our services, or to persons who present an unacceptable level of credit risk.

Scope of Service

The service for which you are agreeing to pay is the advertising of your property for sale on our website.  You agree that responsibility for appropriateness of price, correctness of information about your property, the quality of photographs uploaded, and all other information in the advertisement resides solely with you.  You agree that you will use your best efforts to be thoroughly accurate in everything you upload to the fsboamerica.org site.

Release

In the event that you have a dispute with one or more people who view your advertisement on fsboamerica.org, you agree to release fsboamerica.org, FSBO AMERICA LLC, and our owners, members, agents, subsidiaries, joint venture partners and employees from any and all claims, demands, and damages (actual and consequential) of every kind and nature arising our of or an any way connected to such disputes.

No Warranty

Fsboamerica.org, FSBO AMERICA LLC, nor our owners, members, agents, subsidiaries, joint venture partners, suppliers, or employees provide a warranty of marketability, warranty of title, or any other warranty express or implied; our services are rendered “as is.”  Each advertiser on our site retains full responsibility with regard to any type of warranty whether implicitly stated or implied. 

Termination or Closing your Account

You may terminate your property advertisement at any time by logging back into your account and inactivating your advertisement.  You will need your email address and the password you create during the sign-up process.  If you forget your password, there is a “Forgot Password” feature that automatically sends it to you by email.  You will not be charged for any time after your advertisement is inactivated.  However, you will still owe for any period it was active on the site (after the first free 30 days) for which payment has not yet been received.

By accepting a credit card payment, you agree that you are responsible for the payment if it is reversed.

Removal of Expired Cards

We will notify you of expired credit cards in your account and provide you the opportunity to update those cards before we remove them as a funding source in your account and terminate your property advertisement.

Remedies and fsboamerica.org’s Right to Collect from You

Without limiting other remedies, we may update inaccurate or incorrect information you provide to us, contact you by means other than electronically, limit access to your account and any or all of the account’s functions, indefinitely suspend or close your account and refuse to provide service to you if you fail to provide and maintain accurate credit card information.

Legal Compliance

You agree to comply with the laws of all applicable jurisdictions regarding your use of our services.
