Usually, people groan when forms are mentioned. However, with real estate, forms are relatively simple to use and are a staple of the real estate industry.
The selling or buying of real property is somewhat unique in the business world because it is done almost entirely with real estate forms. In other business areas, parties battle over the minutia of the contract. An offer to buy in a real estate transaction always contains the same basic parameters, so a form is appropriate. The same thing goes for counter offers and so on. In fact, practically every step of the real estate transaction is form oriented.
One common misconception in real estate is that a real estate agent provides custom contracts, offers and such when they represent you. They do not! All an agent does is fill out the very pre-printed forms you can buy above.
Another area of some confusion is whether a universal form will work in all states. It will not. Each state has different laws related to real estate transactions, so you must purchase the appropriate real estate forms for your state. Should you always use real estate forms when handling a real estate transaction? It depends on your comfort level and the transaction. If the transaction is complex, you may want to consult with a real estate attorney. Just be prepared to pay some serious cash.
